15th Annual Latitudes Rewards Photo Contest Official Rules

Welcome to Norwegian Cruise Line's 15th Annual Latitudes Photo Contest (the "Contest"), which begins January 18, 2012, and ends February 29, 2012 ("Entry Period").

ENTRY: Submit a photo taken on a Norwegian Cruise Line vacation between 2010 and 2012. The photograph can be of or on the ship or in port during a cruise vacation. Fill out the online submission form and upload your photograph. A confirmation number will be provided for the submission once the photograph has been successfully uploaded. Entries must be submitted online at latitudesphotocontest.com on or before February 29, 2012. Mailed entries shall not be accepted. Sponsor cannot be responsible for delayed, lost, misdirected or damaged entries. Only one entry allowed per person. Sponsor in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Sponsor's website, or otherwise in violation of the rules. Sponsor further reserves the right to cancel, terminate or modify the Contest not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, force majeure, or technical failures of any sort.

Contestants warrant that their submission is their own original work, it has not been copied from others, and it does not violate the rights of any other person or entry. Photos taken by the ship's photographers will not be considered. All entries become exclusive property of Sponsor upon submission and will not be acknowledged or returned. The copyright in any submission shall remain the property of the contestant, but entry in this Contest constitutes contestant's irrevocable, perpetual permission and consent, without further compensation or attribution, to use the submission and the contestant's name, city, and state for advertising, commercial or publicity purposes by the Sponsor. Sponsor and/or others authorized by the Sponsor shall have the right to edit, adapt, modify trademark, copyright, publish and/or transfer to third parties all photo submissions. Each contestant releases and discharges the Sponsor, their employees, agents, or representatives or any of their parents, subsidiaries, sister companies, or affiliates from any and all liability in connection with the Contest, including without limitation, legal claims, costs, injuries, losses, or damages, demand or actions of any kind.

In the event two or more valid entries contain reasonably similar or identical photographs in Sponsor's sole discretion, Sponsor may draw the prize winner from random selection. Decisions of the Sponsor on all Contest matters are final and binding.

ELIGIBILITY: Contest is open to all Norwegian Cruise Line passengers who are legal residents of the 50 United States and the District of Columbia, and who are at least 18 years of age, except employees of Sponsor or their affiliates, subsidiaries and the immediate family members and resident of the same households of such employees.

WINNER SELECTION: One winner will be selected on or about April 30, 2012 and notified. Entries will be judged by a panel of judges under the direction of Norwegian Cruise Line based on the following criteria: (1) quality of photo; (2) content of photo; (3) and the extent to which the photo represents the experience of cruising with Norwegian. The final selections of the judges will be posted on the Latitudes Rewards magazine web site. Decisions of the judges are final.

PRIZE: One winner and a guest will receive a seven (7) night Caribbean cruise aboard a Norwegian Cruise Line Ship (the "Prize"). Prize includes one oceanview stateroom (double occupancy), excluding suites. Approximate retail value US$2,500.00. Prize does not include government taxes (including income taxes), fee and all expenses not detailed in the Prize description which are the sole responsibility of the winner including: transportation between winner's home and the departure port; shore excursions; travel insurance; merchandise and souvenirs; incidental personal expenses; income and other taxes; and any other costs and expenses not expressly included herein. Odds of winning depend on the number of eligible entries received. The actual Prize value may vary. If the actual value turns out to be less than the stated ARV, the difference will not be awarded in cash. All expenses not specifically included, including but not limited to any taxes or expenses as set forth, are the sole responsibility of the winner. Winner must travel on dates specified by Sponsor, or may forfeit Prize. Certain restrictions and blackout dates apply and exact travel dates and arrangements subject to availability. Winner and guest must travel together on the same itinerary and possess all required travel documents, including visas and valid passports, if and as applicable. The winner of the Prize shall not receive any Latitudes Rewards points for this Prize.

PRIZE REQUIREMENTS: (1) Prize must be redeemed, within one (1) year of award and booked at least forty-five (45) days prior to scheduled travel dates. (2) Minors under the age of 18 must be traveling with parent, legal guardian or spouse over the age of 21 in the same stateroom, who has executed release documentation on behalf of such minor. (3) Travel subject to black-out dates and subject to availability. (4) Potential winner must sign and return an affidavit of eligibility and release within fourteen (14) days of first attempted notification or an alternate winner may be selected and, in the event of noncompliance with this or any other requirement, potential winner will be disqualified. (5) No substitution, exchange or transfer of the Prize except by Sponsor, in which case a Prize of equal or greater value will be substituted. (6) Prize may not be sold, traded, transferred, refunded or redeemed for cash. (6) Winner and guests are responsible for providing proper acknowledges that s/he is over the age of 13 and is granting Sponsor permission to send them marketing messages.

General Rules: Sponsor is not responsible for misdirected entries, entries not received by the entry deadline, or for electronic, network or computer failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in this Contest. Sponsor reserves the right to cancel or modify the Contest (or any portion thereof) if fraud, misconduct or technical failures destroy the integrity of the Contest or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest, as determined by Sponsor, in its sole discretion. If the Contest is so cancelled, judging will be conducted from among all eligible entries received prior to the time of cancellation. In the event a dispute arises regarding any specific individual's entitlement to receive a Prize, an entry made online, the account holder will be declared made by the "authorized account holder". "Authorized account holder" is defined as the natural person who is responsible for the email address. Contestants may be requested to provide Sponsor with proof that the contestant is the authorized account holder associated with the account/submission. Any use of robotic, automatic, programmed or the like methods of participation will void all entries by such methods. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.

By participating, contestant agrees: (i) to be bound by these Official Rules and the decisions of Sponsor, which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law. Taxes, if any, are the sole responsibility of selected contestant, and contestant may be issued an IRS Form 1099 for the adjusted retail value ("ARV") of the awarded Prize.

GOVERNING LAW: Contest governed by the laws of Florida and subject to all applicable federal, state and local laws and regulations. Accordingly, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the contestant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction). The Contest is void where prohibited by any applicable law. Contestants, by participating in this Contest, hereby waive and release, and agree to hold harmless the Sponsor together with their parents, subsidiaries, affiliates, distributors, licensors, advertising and promotion agencies and all of their respective officers, directors, employees and representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death, and /or property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of any Prize, or their participation in this Contest, or any Prize-related activity. By participating in this Contest, contestants agree to be bound by these Official Rules and the decisions of Sponsor. Except where prohibited by law, by accepting a Prize, winner agrees that Sponsor and their related and affiliated companies may use the winner's name, address (city, state), photograph, likeness, and/or Prize information for advertising, publicity and promotional purposes and to the use of statements made by or attributed to winner relating to Sponsor and their related and affiliated companies or to this Contest and grants to Sponsor and their related and affiliated companies any and all rights to said use without further notice and/or compensation except where prohibited by law.

DISPUTE RESOLUTION: Except where prohibited, contestants agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or the Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of Florida or the appropriate Florida State Court located in Miami-Dade County; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3) under no circumstances will a contestant be permitted to obtain awards for, and each contestant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
