Welcome to the NCL Inner Circle website (the "Site"). The Site provides access to an invitation-only online community (the “Program”) operated and managed by Norwegian Cruise Line. The Program is an interactive panel where registered members can answer questions and participate in discussion threads posted for research purposes. Norwegian Cruise Line, in its sole discretion and without notice to you, reserves the right to make changes to the Program and to these Terms of Use from time to time. When we make changes, we will post them here. You may wish to check this section from time to time, because by visiting the Site, you agree to accept any such changes. You are responsible for obtaining access to the Site and that access may involve third party fees (such as Internet service provider or airtime charges). In addition, you must provide and are responsible for all equipment necessary to access the Site and the Program.
1. Participation in the Program
You are authorized to use the Program only for personal, non-commercial purposes. You may not download, copy, or share the content displayed on the Site. Your invitation to participate in the Program is personal and non-transferable. You must be a resident of the United States and 18 years of age or older to be a member of the Program. Neither you nor anyone in your household or immediate family may work for Norwegian Cruise Line, another cruise line, or a market research firm. You may not disclose to others any of the information that we disclose to you or any ideas or information that are generated in the Program. When you register for membership in the Program, you will be required to provide your name, e-mail address, and other information about you. 2. Content
You understand that all opinions, information, data, text, messages or any other materials ("Content"), that are publicly posted on the Site, are the sole responsibility of the person from which such Content originated. You understand that by using the Site, you may be exposed to Content that is opinionated, offensive, indecent or objectionable. Under no circumstances will Norwegian Cruise Line be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Site or membership in the Program.
You further agree that no Content made by you and posted to the Site will be or contain material that is false, misleading, libelous, unlawful, abusive, indecent, discriminatory, or obscene. You further agree that no Content made by you will harass or harm another person. You agree that you will remain responsible for the Content you make. We may review, remove, reject, or revise Content at any time, without prior notice, and in our sole discretion. We may remove, reject, or revise Content that we believe violates these Terms of Use, is otherwise objectionable, or for any other reason without prior notice.
3. Limited License
You grant Norwegian Cruise Line a non-exclusive, royalty-free, perpetual, non-cancellable, worldwide license to use, reproduce, modify, make available to the public, publish, translate, create derivative works from and distribute any Content that you post on the Site.
4. Links to Websites
When you access a non-Norwegian Cruise Line website, please realize that it is independent of Norwegian Cruise Line. Linking to any off-site pages is at your own risk. Norwegian Cruise Line makes no warranties or representations about any non-Norwegian Cruise Line website and has no responsibility for such websites or their content. You acknowledge and agree that Norwegian Cruise Line shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.
5. Copyright and Trademarks
The entire content (images and text) of the Site is copyrighted and may not be reproduced, published, broadcast, posted, modified, transmitted, displayed, distributed, downloaded or otherwise used except as provided herein without the express written permission of Norwegian Cruise Line. All Norwegian Cruise Line trademarks, trade names, service marks, service names, product names, and intellectual property, whether or not delineated in large print or with trademark symbols or in any other fashion, are trademarks and/or intellectual property of Norwegian Cruise Line or its affiliates. The use (except as permitted herein) or misuse of the trademarks or any other intellectual property of Norwegian Cruise Line is expressly prohibited and may be in violation of copyright, trademark, slander or libel laws, privacy law and publicity and communications regulations and statutes. Norwegian Cruise Line actively and aggressively enforces its intellectual property rights to the fullest extent of the law.
You also agree that you will respect the intellectual property rights of others and will not misuse the trademarks, copyrights, or any other intellectual property of others. Norwegian Cruise Line reserves the right to delete and/or remove Content that does not comply.
6. Indemnity
You agree to defend, indemnify and hold Norwegian Cruise Line, its directors, officers, employees, agents, and affiliates harmless from any and all claims, liabilities, damages, costs and expenses, including reasonable attorneys’ fees if any materials you post on or through the
Site or as part of membership in the Program result in a third party claim that any information or material you provide infringes a third party proprietary right.
7. Termination
Norwegian Cruise Line may terminate these Terms of Use and deny you access to the Site at any time, immediately and without notice, if in Norwegian Cruise Line’s sole discretion you fail to comply with any term or condition of these Terms of Use.
8. Opting-out (Leaving the Program)
If at any point you decide that you no longer wish to be a member of the Program, you may opt out by clicking on the “unsubscribe” link at the bottom of any email communication you receive to stop receiving communications. We will retain your information in our "unsubscribe" database to ensure that we do not contact you for this online community in the future.
9. Miscellaneous
These Terms of Use shall be governed by, construed and enforced in accordance with the laws of the State of Florida, without giving effect to any conflict of law provisions. Any dispute arising under these Terms of Use shall be resolved exclusively by an appropriate federal or state
court sitting in the State of Florida. The waiver of any provision of these Terms of Use shall
not be considered a waiver of any other provision or of Norwegian Cruise Line’s right to require strict observance of each of the terms herein. If Norwegian Cruise Line fails at any time to insist upon strict performance of any of your obligations under these Terms of Use, or if Norwegian Cruise Line fails to exercise any of the rights or remedies to which Norwegian Cruise Line is entitled under these Terms of Use, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. If any provision of these Terms of Use is deemed to be illegal or unenforceable, the remainder of these Terms of Use shall be unaffected and shall continue to be fully valid, binding, and enforceable. These Terms of Use constitutes the entire agreement between us relating to your membership in the Program.
